Interpretation and Definitions
Interpretation
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms of Service:
- Application means the software program provided by the Company downloaded by You on any electronic device, named On it Car Maintenance.
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to On it Car Maintenance.
- Service refers to the Application or the Website or both.
- Terms of Service (also referred as "Terms") mean these Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.
- Website refers to On it Car Maintenance, accessible from onitapp.ca.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Eligibility
By accessing or using the Service, You represent and warrant that You are at least 18 years of age and hold a valid driver's license. If You are under the age of 18, You may not use the Service.
User Responsibilities and Account Accuracy
When You create an account with Us, You must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You are specifically responsible for the accuracy of the vehicle data You input into the Application, including but not limited to the Vehicle Identification Number (VIN), historical maintenance records, and current odometer readings. The Application's predictive features rely entirely on the accuracy of the data You provide.
Nature of the Service and Predictive Maintenance
No Professional Advice: The data, alerts, and predictive maintenance schedules provided by the Service are generated based on mathematical models and user-inputted data. They are provided for informational and organizational purposes only and do not constitute professional automotive or mechanical advice.
"As-Is" Estimates: You acknowledge that the Application provides estimates regarding when maintenance may be required. The Application is not a substitute for regular physical inspections by a certified mechanic. You agree not to ignore physical symptoms of mechanical distress, dashboard warning lights, or manufacturer guidelines in reliance on the Application.
Third-Party Services and Mechanics
Facilitator Status: The Service may connect You with independent, third-party automotive mechanics, service centers, or professionals ("Third-Party Providers"). The Company acts solely as a facilitator or marketplace connecting You with these Third-Party Providers.
No Liability for Work Performed: The Company does not employ, endorse, or guarantee the work of any Third-Party Provider. We are not responsible for the quality, safety, legality, or pricing of the services provided by any mechanic You connect with through the Service. Any dispute regarding automotive repairs, property damage, or financial loss resulting from a Third-Party Provider's services is strictly between You and the Third-Party Provider.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, property damage to vehicles, mechanical failures, personal injury, loss of data or other information, for business interruption, or otherwise arising out of or in any way related to the use of or inability to use the Service), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some provinces or jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.
Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service or delete Your account here.
Governing Law
The laws of the Province of Ontario and the federal laws of Canada applicable therein, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, provincial, national, or international laws.
Changes to These Terms of Service
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
